1. Agreement to Terms

By accessing or using the Kairos mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

​

Kairos is a mobile application designed to help you visualize and track time's passage through:

​

• Year progress tracking

• Life progress visualization (based on a 90-year lifespan)

• Widgets for home and lock screen

• Push notifications for reminders and motivation
   

3. Eligibility

​

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. User Accounts

​

4.1 Account Creation

​

To use certain features of the App, you must create an account by providing your birthdate. You agree to:

• Provide accurate and complete information

• Maintain the security of your account credentials

• Notify us immediately of any unauthorized access
   

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
 

• Use the App in any way that violates applicable laws or regulations

• Attempt to gain unauthorized access to the App or its systems

• Interfere with or disrupt the App's functionality

• Reverse engineer, decompile, or disassemble any portion of the App

• Use automated systems (bots, scripts) to access the App

• Remove or modify any copyright, trademark, or proprietary notices

• Use the App to transmit harmful code, viruses, or malware

• Impersonate any person or entity
   

6. Intellectual Property Rights

6.1 Our Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, and design) are owned by Kairos, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.
 

6.2 Limited License
 

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

6.3 Your Data

​

You retain all rights to the personal data you provide to the App. By using the App, you grant us a license to use this data as described in our Privacy Policy.

7. User-Generated Content

​

The App allows you to input personal information (birthdate) for life progress visualizations for entertainment value, and is not meant to be an accurate representation. You retain ownership of this information, but you grant us the right to store and process it as necessary to provide the App's services.

8. Push Notifications

​

By enabling push notifications, you consent to receive messages from the App, including:

​

• Daily or periodic reminders

• Motivational messages

• App updates and announcements
   

You may opt-out of push notifications at any time through your device settings or the App's settings.

9. Third-Party Services
 

The App uses third-party services, including:

​

• Google Cloud Platform (for data storage)

• Firebase Analytics (for anonymous analytics)

• Firebase Cloud Messaging (for push notifications)
   

Your use of these services is subject to their respective terms of service and privacy policies.

10. Disclaimers

10.1 "As Is" Service
 

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Medical or Professional Advice
 

The App is designed for motivational and time-tracking purposes only. It does not provide medical, psychological, or professional advice. The life progress calculations are based on statistical averages and should not be interpreted as predictions or medical assessments.
 

10.3 Accuracy

While we strive for accuracy, we do not guarantee that the App will be error-free, uninterrupted, or free from viruses or other harmful components.

11. Limitation of Liability

​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIROS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

​

• Any indirect, incidental, special, consequential, or punitive damages

• Any loss of profits, data, use, or goodwill

• Any damages resulting from your use or inability to use the App

• Any unauthorized access to or alteration of your data
   

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.
 

12. Indemnification
 

You agree to indemnify, defend, and hold harmless Kairos and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
 

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of another party
   

13. Modifications to the App

We reserve the right to:

​

• Modify or discontinue the App or any features at any time

• Update these Terms from time to time

• Change pricing or introduce fees for the App
   

We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications.

14. Termination

14.1 By You

​

You may stop using the App and delete your account at any time by contacting us or deleting the App from your device.

​

14.2 By Us

​

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:
 

• Violation of these Terms

• Fraudulent or illegal activity

• Extended periods of inactivity

• Any other reason at our sole discretion
   

14.3 Effect of Termination

​

Upon termination:

​

• Your right to use the App will immediately cease

• We may delete your account data in accordance with our Privacy Policy

• Locally stored data will remain on your device until you delete the App
   

15. Geographic Restrictions

​

The App is controlled and operated from the United States. We make no representations that the App is appropriate or available for use in other locations. If you use the App from outside the United States, you are responsible for compliance with local laws.
 

16. Dispute Resolution

16.1 Governing Law
 

These Terms are governed by the laws of Wyoming, United States of America, without regard to conflict of law principles.
 

16.2 Arbitration
 

Any dispute arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if they qualify.
 

16.3 Class Action Waiver
 

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

17. Severability

​

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

​

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kairos regarding the App and supersede any prior agreements.

19. No Waiver

​

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
